GENERAL TERMS AND CONDITIONS OF SALE AND USE

This website is operated under the trade name Astral Chart Factory by Enrique Eduardo Gallardo Queizan, Spanish tax identification number (NIF) 46957408X, with an address at Calle Chimborazo 57, 18008 Granada, Granada, Spain. Contact: support@astralchartfactory.com.

1. SCOPE AND ACCEPTANCE

These terms govern access to astralchartfactory.com and the purchase of personalised birth charts in PDF, poster or framed-poster format. By using the store or placing an order, the customer accepts these terms, the Privacy Policy, the Refund Policy and the Shipping Policy. The mandatory consumer-protection rules of the customer's country shall prevail where applicable.

The customer declares that they have the legal capacity to enter into a contract. Minors may provide data or make purchases only through their parent or legal guardian.

2. PRODUCTS AND NATURE OF THE CONTENT

Each chart is created using the name, date, time and place of birth, together with the options specified by the customer. The sample images are illustrative; the final composition will vary according to those details and the characteristics of the chosen format. Colours may vary slightly depending on the screen and printing process.

The astrological content is interpretative and intended for entertainment. It does not constitute or replace medical, psychological, legal, financial or professional advice.

3. PERSONALISATION DATA

Before paying, the customer must check the name, date, time, city, country and any other personalisation details, as well as the format, size and delivery address. Astral Chart Factory is not liable for errors in the finished product caused solely by incorrect information supplied by the customer, without prejudice to any statutory rights that apply when the product does not conform to the contract.

4. ORDER AND FORMATION OF THE CONTRACT

Placing an order constitutes an offer to purchase. The contract is formed when Astral Chart Factory confirms acceptance of the order after receiving payment authorisation. Confirmation will be sent to the email address provided. We may cancel and refund an order due to unavailability, technical impossibility, reasonable suspicion of fraud or an obvious pricing error, and will inform the customer.

5. PRICES, TAXES AND PAYMENT

The applicable price is the price displayed before the order is confirmed. It includes taxes where required by law. Shipping costs and, where applicable, customs duties or other known charges are displayed before payment. Payments are processed through the providers available at checkout; Astral Chart Factory does not store full payment-card details.

6. PERSONALISED PRODUCTS AND RIGHT OF WITHDRAWAL

Posters and physical products are made to the customer's specifications and are clearly personalised. For this reason, the right of withdrawal for a simple change of mind does not apply once personalisation or production has begun, in accordance with Article 103(c) of the consolidated text of Spain's General Law for the Protection of Consumers and Users. This exception does not limit rights relating to defective, damaged or non-conforming products.

If the customer requests cancellation before personalisation or production begins, we will attempt to stop the order. Cancellation is confirmed only when communicated in writing.

7. DIGITAL CONTENT

The PDF is supplied without a tangible medium through electronic access or delivery once the personalisation is ready. For supply to begin during the withdrawal period, the customer must give express consent and acknowledge that they lose the right of withdrawal once performance begins, in accordance with Article 103(m) of Spanish consumer legislation. The order confirmation will record that consent.

The customer must keep the link or file they receive secure and must not share download access with third parties.

8. CONFORMITY, DAMAGE AND GUARANTEES

If the product arrives damaged, contains an error attributable to Astral Chart Factory or does not match what was agreed, the customer must contact support, state the order number and provide photographs where reasonable. We will provide the appropriate remedy free of charge—correction, replacement, redelivery, price reduction or refund—according to the nature of the issue and the applicable law.

Where Spanish law applies, liability for lack of conformity lasts for three years from delivery of goods and for two years from the supply of digital content delivered in a single act, without prejudice to any more favourable rights established by mandatory rules.

9. PRODUCTION, SHIPPING AND RISK

Physical products are made to order through print providers and sent to the address supplied. Timeframes are estimates and may be affected by production, transport, public holidays, customs or circumstances beyond reasonable control. Where the buyer is a consumer, risk passes when the buyer or a third party designated by them takes physical possession of the product.

The digital PDF does not incur transport costs and must not be sent for physical production. Detailed rates, destinations and conditions are set out in the Shipping Policy.

10. INTELLECTUAL PROPERTY AND LICENCE OF USE

The website, designs, texts, trademarks, images, templates and compositions are protected by Spanish, European and international intellectual-property law. Purchasing a PDF grants the customer a personal, non-exclusive and non-transferable licence to retain it and print copies for private use. It does not permit resale, sublicensing, public distribution, commercial exploitation or presentation of the design or content as the customer's own.

11. USE OF THE WEBSITE AND THIRD-PARTY SERVICES

The website may not be used for unlawful purposes, to introduce malicious code, to attempt unauthorised access, to interfere with its operation or to infringe third-party rights. The store uses Shopify technology and may rely on payment, printing, hosting, email and logistics providers. Each provider is responsible for its own services under its own terms, without reducing the consumer's rights against Astral Chart Factory.

12. PRIVACY AND COMMUNICATIONS

Personal data, including the data required to personalise the chart, is processed in accordance with the Privacy Policy. Transactional communications will be sent using the contact details provided. Marketing communications will be sent only where there is a lawful basis and recipients may unsubscribe at any time.

13. LIABILITY

Nothing in these terms excludes or limits any liability or right that cannot be excluded by law. To the extent permitted, Astral Chart Factory is not liable for losses caused by incorrect customer data, use contrary to these terms, unforeseeable failures by third parties or force majeure. If any provision is invalid, the remaining provisions will continue in effect.

14. CUSTOMER SERVICE AND COMPLAINTS

For questions, cancellations or complaints, email support@astralchartfactory.com and provide the order number where one exists. You may also use the contact page. We will respond within a reasonable period and, where applicable, provide the complaint mechanisms required by applicable law.

15. GOVERNING LAW AND JURISDICTION

These terms are governed by Spanish law. If the customer acts as a consumer, jurisdiction shall lie with the courts determined by mandatory consumer-protection rules, normally those of the customer's place of residence. For customers who are not consumers, the parties submit to the courts having jurisdiction at the proprietor's address, unless a different mandatory rule applies.

16. AMENDMENTS

We may update these terms to reflect legal, technical or commercial changes. The version applicable to each purchase will be the version accepted when the order was placed. The update date appears at the beginning.
